Uyghur Forced Labor Prevention Act Mandate Update

The Uyghur Forced Labor Prevention Act (UFLPA) will came into effect June 8. Starting June 21 CBP is going to assume imports coming from Xinjiang Uyghur Autonomous Region are using forced labor. It will be on the importer to prove otherwise. We expect the top affected commodities include chemicals, apparel/textiles and agriculture.
The Uyghur Forced Labor Prevention Act establishes a rebuttable presumption that any goods produced wholly or in part in China’s Xinjiang Uyghur Autonomous Region or by certain entities are prohibited from importation into the U.S. under 19 U.S.C. 1307. It also mandates the preparation of enforcement and diplomatic strategies.
The bill was created after several reports and investigations found that a variety of goods being produced by Uyghur workers in conditions of forced labor were being imported into the United States.
